Promotional Competition Terms and Conditions:

SECTION 49 CONSUMER PROTECTION ACT NO 68 of 2008 NOTICE, THE FOLLOWING TERMS ARE IMPORTANT TO NOTE:

Clauses: 3, 3.1.1, 4, 4.4 and 6.

1 Campaign:

GamezBoost (the “Competition”). This Competition is organized by Mobile Telephone Networks (Proprietary) Limited (“MTN”) and IMIMobile VAS Ltd FZE (the “Promoter/s”).

2 Campaign Period:

The Competition commences on 0:01 on 1 December 2016 and will continue until 23:59 on 9 February 2017 (the “Competition Period").

3 Who May Enter:

3.1 To be eligible to enter, the entrant must:
3.1.1 be an MTN subscriber (PayAsYouGo, TopUp or Contract);
3.1.2 have a South African ID document or South African Passport;
3.1.3 Customers must be subscribed for a minimum of 3 days and be successfully charged for the minimum duration.
3.1.4 be a natural person; and
3.1.5 be 18 years or older.

3.2 Subscribers must participate in the games as detailed below.

3.3 Participation in this Competition excludes employees, directors, members, partners, consultants and agents of, or any other person who, directly or indirectly controls or is controlled by the Promoter/s or marketing service providers of this Competition, (and the spouses, life partners, immediate family members or business partners of the people or entities listed above. This means:
3.3.1 the Promoter/s;
3.3.2 supplier/s of goods and or services in terms of this Competition; and
3.3.3 promotional partners, printers, advertising and promotional agencies, professional advisors and point of sale staff employed by or contracted to, or providing goods or services of any kind, to all the people or entities listed above during the Competition Period.

4 How to Enter:

4.1 During the Competition Period, the entrants that meet all of the criteria referred to in clause 3 above must do the following in order to stand a chance to win:

4.1.1 In order to Subscribe to the Service a User must dial USSD code *464*369# and will be prompted to accept to subscribe to the service at R 2.00 per day and have the first day free. The customer will then be sent an SMS with a URL link in order to land on the GamezBoost platform. Here the customer will have to enter the tournament section and start playing the games selected for each week of the promotion.
4.1.2 Subscribers will join/subscribe to a series of 8 games which will result in 8 winners to be announced over a period of 8 weeks where each game will run for a duration of 7 days per game (Thursday to the following week Wednesday). Each week a winner will be announced based on a leader board game set up. Once all 8 winners have been chosen they will be invited to compete in elimination rounds playing random games and eliminate each other until there are the last two remaining competitors. The winner of the last two competitors standing based on scores while playing the final game selected will receive the grand prize of R300 000 and the runner up will receive R100 000. The other participants will receive R50 000. The games that will be played each week are in the following order:

4.1.2.1 Candy Slingshot (1 December 2016 to 7 December 2016)
4.1.2.2 Cop Chase (8 December 2016 to 14 December 2016)
4.1.2.3 Mouse Pop (15 December 2016 to 21 December 2016)
4.1.2.4 Candy Swipe (22 December 2016 to 28 December 2016)
4.1.2.5 Penalty Kicks (29 December 2016 to 04 January 2017)
4.1.2.6 Space Shoot Arcade (05 January 2017 to 11 January 2017)
4.1.2.7 Circle Runner (12 January 2017 to 18 January 2017)
4.1.2.8 Tower Jelly (19 January 2017 to 25 January 2017)
4.1.2.9 A single randomly selected game will be played during all the elimination rounds. (9 February 2017- Live rounds)

4.1.3 The winner of each week will be eligible to participate in the elimination rounds during the duration of the promotion. There after the top 8 winners drawn from each round will be eligible to compete in the knockout rounds where they will be playing randomly selected games until the last two competitors are left. These two competitors will battle it out until a winner is obtained based on the highest score between the two.
4.1.4 In order to Unsubscribe from the Service a User will dial USSD code *123*2#. The User will then select Option 10 (Manage Subscriptions) from the Menu in order to Unsubscribe. An SMS notification will be sent to the User informing him/her of their successful unsubscription. The customer will be made aware of the unsubscribing USSD from both the MTN Play Portal as well as on auto renewal SMS’s sent every 30 days.

4.2 The winner for each game shall be the person with the highest score at the end of the week for that particular game and shall not be able to win for the other games selected for the following weeks. They will become 1 of the 8 finalists that will enter into the knockout rounds.

4.3 Winners will be notified telephonically by the Promoter/s and/or its authorized agents on or as soon as possible after the end of each game.

4.4 Entrant’s acknowledge and accept that the Promoter/s shall utilize a third party (the Promoters’ authorized agent/s) to contact the entrant, in the event that the entrant is a winner, and arrange delivery of the Prize. In order to effect the contacting and delivery process, the Promoters shall provide the entrant’s information to such third party.

5 The Prize:

5.1 Entrants that fulfil the requirements stated in clause 3 and 4 above, stand a chance to win:

1x R300 000 cash prize for the winner of the knockout rounds.
1x R100 000 cash prize for the runner up of the knockout rounds.
6x R50 000 cash prize for the remainder of the participants.


(referred to as the “Prize”).

5.2 Prizes shall be delivered to the winner at a time and place to be agreed upon between the Promoter/s and the winner.

6 General:

6.1 The Promoter/s, its respective directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors, subsidiaries and sponsors assume no liability whatsoever for any direct or indirect loss or damage, including but not limited to physical harm or death, howsoever arising from or as a result of an entrant’s participation in the Competition or the entrant’s redemption of any Prize in terms of this Competition, or from any amendments to Prize details and/or the terms and conditions of this Competition. All entrants (including the winner) hereby expressly indemnify the Promoter/s in this regard and shall hold it harmless from all and any claims arising from or as a result of the above reasons.

6.2 In so far as it is necessary, required by law or beyond the reasonable control of the Promoter/s, the Promoter/s reserves the right to vary the nature of the Competition, the Prize, or these terms and conditions upon notice in this regard being published on www.mtn.co.za or in another appropriate medium. In the event that the Prize is limited or varied in this manner, the Promoter/s shall replace the Prize with a prize of a similar economic value.

6.3 With regard to clause 6.2 above, any amended terms and conditions published in any media, or on the MTN website www.mtn.co.za will form part of the terms and conditions of the Competition, to which terms the entrants agree to be bound.

6.4 Winners shall be contacted on the cell phone number/via the medium used to enter the Competition or in terms of any contact details supplied by the winner when entering the Competition. The Promoter/s shall attempt to contact the winner for a period of 3 (three) days after his or her name is drawn as a winner. In the event that the winner is either uncontactable (during the time frames stipulated in this clause 6.4) or in the event that the winner rejects, or declines acceptance of the Prize, the Prize shall be subject to a new draw.

Further, should contact have been made by the Promoter with the winner after they have won a Prize and the winner is thereafter uncontactable for the purposes of delivery of the prize. The Promoter/s shall attempt to contact the winner for a period of 3 (three) days and if the winner is uncontactable, the Prize will be subject to a new draw.

6.5 The Promoters will invite the subscribers who are the weekly winners to be physically present at the Live knockout tournament hosted on the 9 February 2017. Should the winner not be physically present at the live knockout tournament after accepting the invite, they will have forfeited any prize money or chance to compete in the live knockout tournament stages, hosted at the MTN Innovation Centre.

6.6 The customer will have to bring along with them their proof of identity to claim their prize. Only original documents will be accepted not certified copies of any original identity documents. (Original South African ID or South African Passport)

6.7 During the 8 weeks of game play prior to the knockout stage, a customer that has won one week may play on the other games scheduled but may only be declared a winner once during the 8 weeks’ game play.

6.8 The Prize is not transferable and is not exchangeable for another prize or cash and cannot be sold.

6.9 The decision of the Promoter in respect of disputes arising out of this Competition shall be dealt with by the
Promoter in terms of these terms and conditions. The decision of the Promoter in this regard shall be final.

6.10 Winners are only entitled to win 1 (one) Prize each per category.

6.11 The Promoter/s reserve the right to withhold the Prize until it is entirely satisfied that the claimant of the Prize is the bona fide winner, and reserves the right to call for such proof as it may deem necessary.

6.12 The Promoter/s shall request that winners consent in writing to their name, image and likeness being used and published by the Promoter/s in connection with this Competition for a period of 12 (twelve) months after they are announced as winners. Winners may decline the use of their name, likeness and image by the Promoter/s.


6.13 By entering the Competition all entrants give their consent to receive various marketing and promotional material from the Promoter/s. Entrants will be provided with an opportunity to “Opt Out” of receiving such communications, which may be via the relevant medium that such marketing communication was received.

6.14 Winners agree that it is an express condition of the Competition that in order to be eligible to redeem the Prize, the winner shall be required to sign the appropriate acknowledgement of receipt of the Prize, as well as an indemnity and/or waiver of liability as reflected in these terms.
